The GST Council is <strong>chaired by the Union Finance Minister<\/strong> and other members are the Union State Minister of Revenue or Finance and Ministers in-charge of Finance or Taxation of all the States.\u00a0<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">The Constitution (One Hundred and Twenty-Second Amendment) Bill, 2016, for introduction of Goods and Services tax in the country.\u00a0As per Article 279A (4), the Council will make recommendations to the Union and the States on important issues related to GST, like the goods and services that may be subjected or exempted from GST, model GST Laws, principles that govern Place of Supply, threshold limits, GST rates including the floor rates with bands, special rates for raising additional resources during natural calamities\/disasters, special provisions for certain States, etc.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\"><strong>Note:<\/strong>\u00a0The\u00a0<b>One Hundred and Twenty Second Amendment<\/b>\u00a0Bill of the\u00a0Constitution of India, officially known as\u00a0<b>The Constitution (One Hundred and First Amendment) Act, 2016<\/b>, introduced a national\u00a0Goods and Services Tax\u00a0in\u00a0India\u00a0from 1 July 2017.<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"color: #0000ff;\"><a style=\"color: #0000ff;\" href=\"https:\/\/www.oliveboard.in\/ibps-po\/?ref=hny&amp;next=https:\/\/www.oliveboard.in\/myaccount\/buypayu\/cracker.php?c=ibpspo&amp;lc=1\" target=\"_blank\" rel=\"noopener noreferrer\"><strong>Register for IBPS PO Cracker Course only for Rs 999<\/strong><\/a><\/span><\/p>\n<p><a href=\"https:\/\/www.oliveboard.in\/ibps-po\/?ref=hny&amp;next=https:\/\/www.oliveboard.in\/myaccount\/buypayu\/cracker.php?c=ibpspo&amp;lc=1\" target=\"_blank\" rel=\"noopener noreferrer\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter wp-image-41201 size-full\" src=\"https:\/\/static.oliveboard.in\/wp-content\/uploads\/2019\/07\/IBPS-PO-Cracker-banner.png\" alt=\"IBPS-PO-Cracker-banner\" width=\"720\" height=\"90\" \/><\/a><\/p>\n<h2 class=\"rtejustify\" style=\"text-align: justify;\"><span class=\"ez-toc-section\" id=\"GST_Council_%E2%80%93_RBI_Grade_B_Notes\"><\/span><strong><span style=\"color: #000000;\">GST Council &#8211; RBI Grade B Notes<\/span><\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<h3 class=\"rtejustify\" style=\"text-align: justify;\"><span style=\"color: #000000;\"><strong>Mandate of GST Council<\/strong><\/span><\/h3>\n<ol>\n<li class=\"rtejustify\" style=\"text-align: justify;\"><span style=\"color: #000000;\">(279A.) The President shall, within sixty days from the date of commencement of the Constitution (One Hundred and First Amendment) Act, 2016, by order, constitute a Council to be called the Goods and Services Tax Council.<\/span><\/li>\n<li class=\"rtejustify\" style=\"text-align: justify;\"><span style=\"color: #000000;\">The Goods and Services Tax Council shall consist of the following members, namely: \u2014<\/span>\n<ol type=\"a\">\n<li class=\"rtejustify\" style=\"text-align: justify;\"><strong><span style=\"color: #000000;\">the Union Finance Minister &#8211; Chairperson;<\/span><\/strong><\/li>\n<li class=\"rtejustify\" style=\"text-align: justify;\"><strong><span style=\"color: #000000;\">the Union Minister of State in charge of Revenue or Finance &#8211; Member;<\/span><\/strong><\/li>\n<li class=\"rtejustify\" style=\"text-align: justify;\"><strong><span style=\"color: #000000;\">the Minister in charge of Finance or Taxation or any other\u00a0<\/span><span style=\"color: #000000;\">Minister nominated by each State Government &#8211; Members.<\/span><\/strong><\/li>\n<\/ol>\n<\/li>\n<li class=\"rtejustify\" style=\"text-align: justify;\"><span style=\"color: #000000;\">The Members of the Goods and Services Tax Council referred to in sub-clause (c) of clause (2) shall, as soon as may be, choose one amongst themselves to be the Vice-Chairperson of the Council for such period as they may decide.<\/span><\/li>\n<li class=\"rtejustify\" style=\"text-align: justify;\"><span style=\"color: #000000;\">The Goods and Services Tax Council shall make recommendations to the Union and the States on\u2014<\/span>\n<ul type=\"a\">\n<li class=\"rtejustify\"><span style=\"color: #000000;\">the taxes, cesses and surcharges levied by the Union, the States and the local bodies which may be subsumed in the goods and services tax;<\/span><\/li>\n<li class=\"rtejustify\"><span style=\"color: #000000;\">the goods and services that may be subjected to, or exempted from the goods and services tax;<\/span><\/li>\n<li class=\"rtejustify\"><span style=\"color: #000000;\">model Goods and Services Tax Laws, principles of levy, apportionment of Goods and Services Tax levied on supplies in the course of inter-State trade or commerce under article 269A and the principles that govern the place of supply;<\/span><\/li>\n<li class=\"rtejustify\"><span style=\"color: #000000;\">the threshold limit of turnover below which goods and services may be exempted from goods and services tax;<\/span><\/li>\n<li class=\"rtejustify\"><span style=\"color: #000000;\">the rates including floor rates with bands of goods and services tax;<\/span><\/li>\n<li class=\"rtejustify\"><span style=\"color: #000000;\">any special rate or rates for a specified period, to raise additional resources during any natural calamity or disaster;<\/span><\/li>\n<li class=\"rtejustify\"><span style=\"color: #000000;\">special provision with respect to the States of Arunachal Pradesh, Assam, Jammu and Kashmir, Manipur, Meghalaya, Mizoram, Nagaland, Sikkim, Tripura, Himachal Pradesh and Uttarakhand; and<\/span><\/li>\n<li class=\"rtejustify\"><span style=\"color: #000000;\">any other matter relating to the goods and services tax, as the Council may decide.<\/span><\/li>\n<\/ul>\n<\/li>\n<li class=\"rtejustify\" style=\"text-align: justify;\"><span style=\"color: #000000;\">The Goods and Services Tax Council shall recommend the date on which the goods and services tax be levied on petroleum crude, high speed diesel, motor spirit (commonly known as petrol), natural gas and aviation turbine fuel.<\/span><\/li>\n<li class=\"rtejustify\" style=\"text-align: justify;\"><span style=\"color: #000000;\">While discharging the functions conferred by this article, the Goods and Services Tax Council shall be guided by the need for a harmonized structure of goods and services tax and for the development of a harmonized national market for goods and services.<\/span><\/li>\n<li class=\"rtejustify\" style=\"text-align: justify;\"><span style=\"color: #000000;\">One-half of the total number of Members of the Goods and Services Tax Council shall constitute the quorum at its meetings.<\/span><\/li>\n<li class=\"rtejustify\" style=\"text-align: justify;\"><span style=\"color: #000000;\">The Goods and Services Tax Council shall determine the procedure in the performance of its functions.<\/span><\/li>\n<li class=\"rtejustify\" style=\"text-align: justify;\"><span style=\"color: #000000;\">Every decision of the Goods and Services Tax Council shall be taken at a meeting, by a majority of not less than three-fourths of the weighted votes of the members present and voting, in accordance with the following principles, namely: \u2014<\/span>\n<ul type=\"a\">\n<li class=\"rtejustify\"><span style=\"color: #000000;\">the vote of the Central Government shall have a weightage of one third of the total votes cast, and<\/span><\/li>\n<li class=\"rtejustify\"><span style=\"color: #000000;\">the votes of all the State Governments taken together shall have a weightage of two-thirds of the total votes cast, in that meeting.<\/span><\/li>\n<\/ul>\n<\/li>\n<li class=\"rtejustify\" style=\"text-align: justify;\"><span style=\"color: #000000;\">No act or proceedings of the Goods and Services Tax Council shall be invalid merely by reason of\u2014<\/span>\n<ul type=\"a\">\n<li class=\"rtejustify\"><span style=\"color: #000000;\">any vacancy in, or any defect in, the constitution of the Council; or<\/span><\/li>\n<li class=\"rtejustify\"><span style=\"color: #000000;\">any defect in the appointment of a person as a Member of the Council; or<\/span><\/li>\n<li class=\"rtejustify\"><span style=\"color: #000000;\">any procedural irregularity of the Council not affecting the merits of the case.<\/span><\/li>\n<\/ul>\n<\/li>\n<li class=\"rtejustify\"><span style=\"color: #000000;\">The Goods and Services Tax Council shall establish a mechanism to adjudicate any dispute \u2014<\/span>\n<ul type=\"a\">\n<li class=\"rtejustify\" style=\"text-align: justify;\"><span style=\"color: #000000;\">between the Government of India and one or more States; or<\/span><\/li>\n<li class=\"rtejustify\" style=\"text-align: justify;\"><span style=\"color: #000000;\">between the Government of India and any State or States on one side and one or more other States on the other side; GST rate on all Electric Vehicles reduced from 12% to 5% and of charger or charging stations for EVs from 18% to 5%<\/strong><\/span><br \/>\n<span style=\"color: #000000;\"><strong><br \/>\n2. Hiring of electric buses by local authorities exempted from GST<\/strong><\/span><\/h4>\n<h4><span style=\"color: #000000;\"><strong>3.
