But the main six fundamental rights are under article 14-32. Article 12 deals with the definition of state. Article 13 deals with Laws Inconsistent with or in derogation of the <strong>fundamental rights<\/strong>.&nbsp;<\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>Definition of state &#8211; Article 12 <\/strong><\/h4>\n\n\n\n<p>\u201d In this Part, unless the context otherwise requires, \u201cthe State\u2019\u2019 includes the Government and Parliament of India and the Government and the Legislature of each of the States and all local or other authorities within the territory of India or under the control of the Government of India\u201d.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>Laws Inconsistent with or in derogation of the fundamental rights &#8211; Article 13 <\/strong><\/h4>\n\n\n\n<p>(1) All laws in force in the territory of India immediately before the commencement of this Constitution, in so far as they are inconsistent with the provisions of this Part, shall, to the extent of such inconsistency, be void.&nbsp;<\/p>\n\n\n\n<p>(2) The State shall not make any law which takes away or abridges the rights conferred by this Part and any law made in contravention of this clause shall, to the extent of the contravention, be void.<\/p>\n\n\n\n<p>&nbsp;(3) In this article, unless the context otherwise requires,\u2014<\/p>\n\n\n\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;(a) \u201claw\u201d includes any Ordinance, order, bye-law, rule, regulation, notification, custom or usage having in the territory of India the force of law;&nbsp;<\/p>\n\n\n\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;(b) \u201claws in force\u201d includes laws passed or made by a Legislature or other competent authority in the territory of India before the commencement of this Constitution and not previously repealed, notwithstanding that any such law or any part thereof may not be then in operation either at all or in particular areas.&nbsp;<\/p>\n\n\n\n<p>(4) Nothing in this article shall apply to any amendment of this Constitution made under article 368.<\/p>\n\n\n\n\n\n<h4 class=\"wp-block-heading\">Right to Equality Article 14-18&nbsp;<\/h4>\n\n\n\n<p>The first <strong>Fundamental right <\/strong>is Right to equality.&nbsp;<\/p>\n\n\n\n<p>Article 14- Equality before law and equal protection of laws within the territory of India&nbsp;<\/p>\n\n\n\n<p>Article 15- Prohibition of discrimination on grounds of religion, race, caste, sex or place of birth.<\/p>\n\n\n\n<p>Article 16- Equality of opportunity in matters of public employment.<\/p>\n\n\n\n<p>Article 17- Abolition of Untouchability and prohibition of its practice<\/p>\n\n\n\n<p>Article 18- Abolition of titles except military and academic&nbsp;&nbsp;<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">Right to Freedom (Article 19-22)<\/h4>\n\n\n\n<p>Article 19 &#8211; Under this Article the constitution guarantees to the citizens of India six <strong>Fundamental rights<\/strong> of Freedom. As written in the Constitution,<\/p>\n\n\n\n<p>All citizens shall have the <strong>Fundamental right<\/strong>\u2014&nbsp;<\/p>\n\n\n\n<p>(a) to freedom of speech and expression&nbsp; (Freedom of Press, Media)<\/p>\n\n\n\n<p>(b) to assemble peaceably and without arms&nbsp;<\/p>\n\n\n\n<p>(c) to form associations or unions&nbsp;<\/p>\n\n\n\n<p>(d) to move freely throughout the territory of India<\/p>\n\n\n\n<p>(e) to reside and settle in any part of the territory of India<\/p>\n\n\n\n<p>Article 20- It gives the Protection in respect of conviction for offenses<\/p>\n\n\n\n<p>Article 21- It gives the Protection of life and personal liberty to both citizen and non-citizen, article 20 and 21 remain in force even during emergencies.&nbsp;<\/p>\n\n\n\n<p>Article 21A- Right to education- The State shall provide free and compulsory education to all children of the age of six to fourteen years in such manner as the State may, by law, determine.<\/p>\n\n\n\n<p>Article 22 &#8211; Protection against arrest and detention in certain cases. The right is not available to an enemy alien and a person arrested or detained under a law providing preventive detention (detention of person without trial)<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">Right to against exploitation Article 23 and 24<\/h4>\n\n\n\n<p>Article 23- It entails Prohibition of traffic in human beings and forced labor.<\/p>\n\n\n\n<p>&nbsp;Article 24-&nbsp; No child below the age of fourteen years shall be employed to work in any factory or mine or engaged in any other hazardous employment.<\/p>\n\n\n\n<p>Right to Freedom of Religion Article 25-28<\/p>\n\n\n\n<p>Article 25- Freedom of conscience and free profession, practice and propagation of religion.<\/p>\n\n\n\n<p>Article 26- Freedom to manage religious affairs.<\/p>\n\n\n\n<p>Article 27- Freedom as to payment of taxes for promotion of any particular religion.<\/p>\n\n\n\n<p>Article 28- Freedom as to attendance at religious instruction or religious worship in certain educational institutions.<\/p>\n\n\n\n<div class=\"wp-block-buttons aligncenter is-layout-flex wp-block-buttons-is-layout-flex\">\n<div class=\"wp-block-button\"><a class=\"wp-block-button__link\" href=\"https:\/\/www.oliveboard.in\/karnataka-police-constable\/?ref=cont-soum\" target=\"_blank\" rel=\"noreferrer noopener\">take a free KSP mock test<\/a><\/div>\n<\/div>\n\n\n\n<h4 class=\"wp-block-heading\">Cultural and Educational Rights Article 29-30<\/h4>\n\n\n\n<p>Article 29-&nbsp; Any section of the citizens residing in the territory of India or any part thereof having a distinct language, script or culture of its own shall have the right to conserve the same. No citizen shall be denied admission into any educational institution maintained by the State or receiving aid out of State funds on grounds only of religion, race, caste, language or any of them.&nbsp;<\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>Fundamental Rights<\/strong> Article 30-<\/h4>\n\n\n\n<p> Right of minorities to establish and administer educational institutions.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">Right to Property Article 31 &#8211; <\/h4>\n\n\n\n<p>Omitted from<strong> fundamental rights<\/strong> by the 44th amendment act 1978 and now it considered as a legal right<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">Right to Constitutional Remedies Article 32<\/h4>\n\n\n\n<p>Article 32- It provides the right to the citizens to move to the supreme court by appropriate proceedings for the enforcement of the <strong>fundamental rights<\/strong> and it empowers the supreme court to issue direction or writs for the enforcement of the fundamental rights. A special majority of parliament should pass the amendment bill.Supreme Court has the power to overturn the constitutional amendment if it is violating the basic structure of the constitution.<strong> Fundamental rights<\/strong> are subjected to amendment on the condition of non-violation of the basic structure of the constitution.&nbsp;<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">Decisions of Supreme Court Regarding Amendment of <strong>Fundamental rights\u00a0<\/strong><\/h4>\n\n\n\n<figure class=\"wp-block-table is-style-regular\"><table><tbody><tr><td>Year<\/td><td>Case<\/td><td>Verdict<\/td><\/tr><tr><td>1965<\/td><td>Sajjan Singh vs State of Rajasthan&nbsp;<\/td><td>In addition to amending basic rights, the Parliament may also amend any other part of the Constitution.<\/td><\/tr><tr><td>1967<\/td><td>Golaknath vs State of Punjab<\/td><td>Parliament had no power to amend <strong>fundamental rights<\/strong> of the Constitution<\/td><\/tr><tr><td>1971<\/td><td>24th amendment 1971<\/td><td>Reaction to the Golaknath case the absolute power of the Parliament to amend any part of the Constitution including Part III i.e, <strong>fundamental rights<\/strong> was restored.&nbsp;<\/td><\/tr><tr><td>1973<\/td><td>Kesavananda Bharati vs State of Kerala<\/td><td>The court held that while the Parliament has &#8216;wide&#8217; powers, it did not have the power to destroy or emasculate the basic elements or fundamental features of the constitution.<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<p>In 1981 supreme court restated the basic structure of the constitution which should not be violated in any type of amendments.\u00a0<\/p>\n\n\n\n<div class=\"wp-block-buttons aligncenter is-layout-flex wp-block-buttons-is-layout-flex\">\n<div class=\"wp-block-button\"><a class=\"wp-block-button__link\" href=\"https:\/\/www.oliveboard.in\/karnataka-police-constable\/?ref=cont-soum\" target=\"_blank\" rel=\"noreferrer noopener\">take a free KSP mock test<\/a><\/div>\n<\/div>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Fundamental_Duties\"><\/span><strong>Fundamental Duties&nbsp;<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<ul class=\"wp-block-list\"><li>When the Constitution was adopted in the year 1949, there were no provisions regarding <strong>Fundamental Duties<\/strong> to the Citizens though there was a Part III for <strong>Fundamental Rights<\/strong>.<\/li><li>The <strong>Fundamental Duties <\/strong>of citizens were added to the Constitution by the 42nd Amendment in 1976, upon the recommendations of the Swaran Singh Committee that was constituted by the Government.\u00a0<\/li><li>The Committee suggested that steps needed to be taken to ensure that the individual did not overlook his duties while in exercise of his <strong>Fundamental Rights<\/strong>.\u00a0<\/li><li>By way of the 42nd Constitution (Amendment) Act, 1976, a new Chapter IV-A which consists of only one Article i.e 51-A was added which dealt with a Code of Ten <strong>Fundamental Duties<\/strong> for citizens. Originally ten <strong>fundamental duties <\/strong>were listed. Later on, by virtue of the 86th Constitution the Amendment in 2002, 11th duty was added<\/li><li><strong>\u00a0Fundamental duties<\/strong> are intended to serve as a constant reminder to every citizen that while the constitution specifically conferred on them certain<strong> Fundamental Rights<\/strong>, it also requires citizens to observe certain basic norms of democratic conduct and democratic behavior because <strong>fundamental rights and duties<\/strong> are correlative.<\/li><li>\u00a0The inclusion of <strong>Fundamental Duties<\/strong> brought our Constitution in line with article 29 (1) of the Universal Declaration of Human Rights and with provisions in several modern Constitutions of other countries. The concept of Fundamental duties was taken from the USSR.\u00a0<\/li><li>The <strong>Fundamental duties<\/strong> are essentially taken from the Indian tradition, mythology, religions and practices.
