Cultural and Educational Rights:<\/strong> The Indian Constitution grants six fundamental rights to citizens of India and Cultural and Educational Rights is the fifth among these rights.<\/p>\n\n\n\n

In this blog, we will be discussing the Cultural and Educational Rights that are covered in Articles 29 and 30 of the Indian Constitution.<\/p>\n\n\n\n

The aim of Cultural and Educational Rights is to protect the linguistic, cultural, and religious rights of minorities. It attempts to preserve the culture and heritage of all communities.<\/p>\n\n\n\n

Article 29 – Protection of Interests of Minorities<\/h3>\n\n\n\n

Article 29 deals with right of protection of interests of minorities. The following are the points that are covered in this article.<\/p>\n\n\n\n

Article 29(1)<\/strong> states that any section of the citizens residing in the territory of India or any part thereof having a distinct language, script or culture of its own shall have the right to conserve the same.<\/p>\n\n\n\n

Article 29(2)<\/strong> states that no citizen shall be denied admission into any educational institution maintained by the State or receiving aid out of State funds on grounds only of religion, race, caste, language or any of them.<\/p>\n\n\n\n

Article 30 – Right of Minorities to Establish and Administer Educational Institutions<\/h3>\n\n\n\n

Article 30 is also known as the “Charter of Education Rights”. The aim of Article 30 is to provide the minorities with the right to establish and maintain the administrative duties of the educational institutes.<\/p>\n\n\n\n

The following are covered under this article <\/p>\n\n\n\n

Article 30(1) states that all minorities, whether based on language or religion have the right to establish and administer the educational institutions of their choice.<\/p>\n\n\n\n

Article 30(2) states that the State shall not discriminate at the time of granting aid to educational institutions based on the grounds that it is managed by a minority whether based on religion or language.<\/p>\n\n\n\n
