What is Halqa Panchayat?

Halqa” means the area comprising a village or such contiguous number of villages as may be determined by the Government from time to time and a Halqa Panchayat refers to Halqa Panchayats that is constituted under section 4 of this Act. Here the act refers to the Jammu and Kashmir Panchayati Raj Act, 1989.

Halqa Majlis

Halqa Majlis refers to all the voters or those people whose names are included in the electoral roll of a designated Halqa Panchayat.

Sarpanch

Sarpanch as the title suggests is the head of the panches or head of the panchayat. In other words, the sarpanch is the head of the Halqa Panchayat. A sarpanch should conduct at least two meetings of the Halqa Majlis in a financial year.

Panches

Panches are members of the panchayat who assist the sarpanch in conducting the panchayat. The number of panches can be a minimum of 7 and a maximum of 11 including the sarpanch.

Important Points

  • The reservation of seats of panch for SC and ST should be proportionate to the population.
  • Also, one-third of the seats from the reserved category as well as from the total panches should be women.

Naib Sarpanch

Naib Sarpanch is one member of the panchayat who is selected by indirect election in the first notified meeting of Halqa Majlis.

Village Level Worker or Panchayat Secretary

Village Level Worker (VLW) or Panchayat Secretary as the name suggests is the secretary of the Halqa Panchayat.

Corporate body

As the Halqa Panchayat is a corporate body it can sue or it can be sued by its corporate name. The term of office for Halqa Panchayat is 5 years.

Conditions of Disqualification

The following are conditions of disqualification:

a. PRC of state

b. Govt or local body employee

c. Less than 25 yrs old

d. Unsound mind

e. Adjudged insolvent

f. Salaried servant of Halqa Panchayat

g. Lamerdar/chowkidar

h. If crime is greater than 2 yr and no political crime

i. If the name is not there on the electoral roll

j. Presenting false SC or ST certificate leads to a 6-year disqualification from the date of finding

Removal of Sarpanch and Naib Sarpanch

Sarpanch and Naib Sarpanch can be removed from the posts if two-thirds of the total number of panches vote in favour of the removal.

The Sarpanch and Naib Sarpanch can be removed on the following grounds:

(a) Gross misconduct

(b) Neglect of duty

(c) Disqualified

(d) Six consecutive meetings missed

The vacancies must be filled by election or nomination as the case may be. The vacancies must be there for a duration greater than 6 months.

Supercesssion of Halqa Panchayat

The Halqa Panchayat undergo supercession from the government by notification if the panchayat is found to be incompetent or defaulting in duty. Before supercession, there will be an issue of show cause notice before the order is passed.

If supercession happens, there should be an election within 6 months.

Resignation

The resignation should be submitted to the prescribed authority. Here the “Prescribed Authority” means such authority as may be appointed by the Government by notification, for all or any of the provisions of this Act.

Power and Functions of Halqa Panchayat

The following are the powers and functions of Halqa Panchayat:

  • Development plans for the designated Halqa. Preparation and implementation of those plans.
  • Regulations of dangerous trades, slaughter houses etc that come under the respective halqa
  • Implementing poverty alleviation programmes like IRDP, NREP etc for the improvement of quality of life of respective halqa.

Sources of Funds for Halqa Panchayat

a. Taxes and fees as applicable for the halqa

b. Proceeds from the sale of property

c. Fee, compensation, fines granted from court

d. Sanitation cess by Govt

e. Donations from people, organisations or government

f. Grants sanctioned by Government

g. Backward region grants
