Constitutional Provisions Related to Council of Ministers
The Indian Constitution outlines the framework for the Council of Ministers in several key articles:
Article 74(1): This article establishes the Council of Ministers itself, stating that there shall be a council with a Prime Minister at its head to aid and advise the President.
Article 75: This article dives deeper into the specifics of the Council, including:
- Appointment: The Prime Minister is chosen by the President, and other ministers are appointed by the President on the advice of the Prime Minister. [This doesn’t specify an election process]
- Tenure: Ministers hold office “during the pleasure of the President,” meaning they can be removed by the President at any time.
- Responsibility: The Council of Ministers is collectively responsible to the House of the People (Lok Sabha). This means all ministers share responsibility for the government’s actions to the lower house of Parliament.
Additional Points:
- The Constitution mentions different categories of ministers like Cabinet Ministers, Ministers of State, and Deputy Ministers, but the specific structure is determined by the Prime Minister.
- The concept of individual responsibility is also implied. Though collectively responsible, a minister can be removed for individual actions.
It’s important to note that some aspects of the Council of Ministers, like collective responsibility, are based on conventions (unwritten rules) alongside the Constitution.
