In a notable development, the Madhya Pradesh (MP) cabinet, led by Chief Minister Shivraj Singh Chouhan, has given the green light to the Mob Lynching Victim Compensation Scheme. This initiative offers compensation and support to victims and their families affected by mob violence incidents.
About the Mob Lynching Victim Compensation Scheme 2023
Objectives
- The goal of the Mob Lynching Victim Compensation Scheme in Madhya Pradesh is to grant compensation and assistance to victims and their families in instances of mob violence.
- In cases where a victim loses their life in a mob lynching incident, their family will be entitled to receive Rs 10 lakh as compensation.
- Injured victims will receive compensation ranging from Rs 4 to 6 lakh.
- This scheme is in compliance with the directives from the Supreme Court issued in 2018, which stressed the need for such compensation schemes to effectively address mob violence.
Recent Mob Lynching
- In the wake of recent mob attacks in the Khandwa region of Madhya Pradesh, including assaults on individuals for carrying meat or their social media posts, the state government has made it a top priority to tackle this issue.
- These incidents have highlighted the pressing need to take action and implement measures to prevent mob violence.
Reasons behind the introduction of the scheme
- The Madhya Pradesh Cabinet gave its approval to this scheme in accordance with the directives from the Supreme Court (issued in July 2018).
- These directives were a result of the judgment in the case of Tehseen S Poonawalla vs. Union of India & Others.
- The Supreme Court’s directives urged state governments to establish compensation schemes for victims of lynching and mob violence.
Legal Directives
- The directives underscored the importance of taking into account the extent of physical and psychological injuries, the loss of earnings, expenses related to legal and medical matters, and the swift provision of interim relief within 30 days of the incident.
- The approval of the scheme is a direct response to these legal directives, with the aim of granting compensation and assistance to victims and their families in instances of mob violence.
Criteria for receiving compensation
- The Mob Lynching Victim Compensation Scheme in Madhya Pradesh offers compensation to victims and their families based on specific criteria.
- Compensation is provided to victims who have suffered harm or injury due to “any act or series of acts of violence by a mob, involving five or more individuals.”
- The grounds for eligibility encompass various factors, including religion, caste, gender, place of birth, language, food preferences, sexual preferences, political affiliations, ethnicity, and more.
- This scheme addresses the issue of mob violence by providing financial support and relief to those affected by such incidents, aligning with Supreme Court directives and the imperative to combat mob violence effectively.
