Right to Freedom of Religion ( Article 25-28)

Right to freedom of religion is covered under Article 25-28 and it guarantees the freedom to practice their own religion without any obstruction. The following rights are covered under Articles 25-28.

Article 25 – Freedom of conscience and free profession, practice and propagation of religion

Article 25 deals with the freedom of conscience and also the freedom to profess, practice and propagation of religion provided that it is subjected to public order, morality, health, and other provisions.

It also states that this article will not impact any existing law or prevent the State from making any new law for:

a. regulating or restricting any economic, financial, political or other secular activity which may be associated with religious practice

b. providing for social welfare and reform or the throwing open of Hindu religious institutions of a public character to all classes and sections of Hindus.

In this regard, the practice of carrying kirpan by the Sikhs is considered a part of their profession of Sikh religion.

Article 26 – Freedom to manage religious affairs

This article states that subject to the conditions of public order, morality and health, every religious denomination or any section thereof shall have the following rights:

(a) to establish and maintain institutions purely for religious and charitable purposes.

(b) to manage its own affairs in matters of religion without obstruction.

(c) to own and acquire movable and immovable property.

(d) to administer such property in accordance with existing statutes of law.

Article 27 – Freedom as to payment of taxes for promotion of any particular religion

According to Article 27, no person should be forced to pay taxes, on spending money for the payment of expenses for the promotion or maintenance of any particular religion or religious denomination.

Article 28 – Freedom as to attendance at religious instruction or religious worship in certain educational institutions

Article 28 deals with the prohibition of religious instruction to students in educational institutions fully funded by the state. The exception to this rule is that educational institutions that were established under any endowment or trust require the imparting of religious instruction.

It also prohibits any person who attends any educational institution recognised by the State or receives aid out of State funds to take part in any religious instruction that may be imparted in such institution.

In addition to that, it also prohibits attending any such religious worship that is conducted in such institutions unless specific consent is received from him /her.

In the case of minors, the consent is needed from the guardian.
